FAITH JANITORIAL CORPORATION
MASTER TERMS OF SERVICE, SERVICE AGREEMENT & LIABILITY WAIVER
Effective Date: January 1, 2026
Welcome to Faith Janitorial Corporation (“FJC,” “Company,” “we,” “our,” or “us”). By scheduling, approving, purchasing, or receiving services from Faith Janitorial Corporation, you (“Customer,” “Client,” or “Property Owner”) acknowledge that you have read, understood, and agreed to the following Terms of Service and Liability Waiver.
These Terms of Service, Service Agreement, and Liability Waiver apply to all residential, commercial, industrial, construction, post-construction, janitorial, disinfecting, specialty, and deepcleaning services provided by Faith Janitorial Corporation and/or its division, DeepCleaners of America.
1. SERVICE UNDERSTANDING
Faith Janitorial Corporation provides professional commercial-grade cleaning and deepcleaning services. Our services are intended to improve cleanliness, appearance, sanitation, and the functionality of surfaces and environments.
Due to the condition, age, wear, construction, prior maintenance history, materials, contamination level, or pre-existing damage of certain properties or items, the Company cannot guarantee restoration to a new condition, perfection, complete stain removal, odor elimination, or permanent results.
Cleaning may reveal hidden damage, discoloration, deterioration, scratches, faded finishes, loose materials, prior repairs, or installation defects that existed before service.
2. CUSTOMER RESPONSIBILITIES
The Customer agrees to:
- Provide safe and legal access to the property
- Ensure utilities (water, electricity, etc.) are active
- Secure or remove fragile, valuable, sentimental, or irreplaceable items
- Inform the Company of any hazardous conditions, biohazards, mold, asbestos, lead paint, pest infestations, structural concerns, or chemical sensitivities
- Keep children and pets safely away from active work areas
- Provide accurate service details before work begins
- Ensure that employees of your company are aware of the services and areas included in your scope of work (SOW) to help minimize misunderstandings related to service compliance
Faith Janitorial Corporation reserves the right to refuse, stop, or modify services if unsafe, hazardous, hostile, illegal, or unreasonable conditions exist.
3. ESTIMATES & PRICING
All estimates and proposals are based on visible conditions and information available at the time of inspection or booking.
Actual pricing may increase if additional labor, contamination, buildup, damage, excessive soil levels, unexpected conditions, or additional requested services are discovered during the cleaning process.
Examples of heavy soil conditions include but are not limited to:
- Smoke residue
- Pet hair accumulation
- Grease buildup
- Mold or mildew staining
- Hard water scale
- Rust staining
- Sticky residue
- Excessive dust accumulation
- Bodily fluids or biological contaminants
- Construction debris
The Customer authorizes reasonable adjustments necessary to complete the requested work professionally.
4. DEPOSITS & PAYMENTS
Deposits may be required for large projects, specialty services, scheduling reservations, equipment allocation, or labor-intensive work.
Unless otherwise agreed in writing:
- Payment is due upon completion of services for one-time deepcleaning customers
- Commercial accounts may receive approved billing terms
- A $29.00 late fee is charged on past-due invoices (after a 5-day grace period)
- Late balances may incur finance charges monthly
- Returned checks are subject to additional fees
- The Customer is responsible for all collection costs, attorney fees, and court costs associated with unpaid balances
Deposits may be non-refundable once scheduling, staffing, equipment reservations, or project preparation has begun.
5. CANCELLATION & RESCHEDULING
To protect scheduling availability and labor commitments:
- Cancellations with less than 24 hours’ notice may be subject to cancellation fees
- Same-day cancellations may result in forfeiture of deposits
- Locked-out appointments or denied access may incur service charges
- Excessive rescheduling may require new deposits before future scheduling
Weather events, emergencies, equipment failures, staffing shortages, or circumstances beyond Company control may require rescheduling.
6. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
Faith Janitorial Corporation, its owners, employees, subcontractors, affiliates, divisions, agents, or representatives shall not be liable for:
- Pre-existing damage
- Wear and tear
- Deteriorated materials
- Oxidation
- Improper installations
- Loose caulking, grout, trim, or fixtures
- Flooring separation or adhesive failure
- Paint failure
- Water intrusion
- Hidden mold
- Rust exposure
- Surface etching
- Stain reappearance
- Odor return
- Furniture or item instability
- Damage caused by aging or defective materials
- Electronics or appliance malfunction unrelated to negligence
- Temporary disruption of business operations
- Slip hazards caused by wet surfaces during or immediately after service
The Customer agrees that the maximum liability of Faith Janitorial Corporation for any claim shall not exceed the total amount paid for the specific service performed.
Under no circumstances shall the Company be liable for indirect, incidental, punitive, consequential, or special damages.
7. SATISFACTION CONCERNS
Customer satisfaction is important to us.
Any service concerns must be reported in writing within twenty-four (24) hours of service completion to allow the Company an opportunity to inspect and address the concern.
Failure to report concerns within this timeframe constitutes acceptance of completed work.
Submitting a concern does not automatically entitle the Customer to refunds, discounts, or free additional services. All service concerns that can be corrected by cleaning will be redone.
8. READINESS FOR SERVICE
To ensure safe, efficient, and high-quality service, all areas scheduled for cleaning must be properly prepared and reasonably ready for service prior to Faith Janitorial Corporation’s arrival.
Residential Deepcleaning Services
For residential services, the Customer is responsible for ensuring that all requested cleaning areas are accessible and reasonably prepared before service begins. Standard cleaning pricing does not include excessive organizing, decluttering, sorting, moving heavy furniture, removing personal belongings, excessive trash removal, or preparation of service areas unless specifically included within the approved estimate or proposal.
The Customer agrees to:
- Remove or secure valuable, fragile, or sentimental items
- Remove excessive clutter, clothing, toys, paperwork, dishes, or miscellaneous belongings from service areas
- Ensure utilities such as electricity and water are active and functioning
- Secure pets appropriately during service
- Provide safe and unobstructed access to all requested work areas
Additional charges may apply if our crews are required to spend additional time preparing areas before cleaning can begin.
Commercial & Janitorial Service Clients
For commercial, industrial, office, warehouse, healthcare, retail, construction, or property management clients, all scheduled work areas must be reasonably ready and accessible for service upon our arrival.
The Customer is responsible for:
- Informing staff or occupants of scheduled service dates
- Ensuring reasonable access to all approved cleaning areas
- Removing excessive obstructions, hazards, confidential materials, loose paperwork, or unsafe conditions from work areas
- Providing safe working conditions compliant with applicable OSHA and workplace safety requirements
- Ensuring all trash is properly bagged and contained when applicable
- Making arrangements for after-hours access, alarms, keys, badges, elevators, loading docks, or security procedures when required
Unless specifically included in writing, standard janitorial pricing does not include:
- Organizing desks or personal workspaces
- Moving excessive furniture or equipment
- Handling confidential documents
- Moving pallets, inventory, machinery, or construction materials
- Excessive trash hauling or disposal services
- Cleanup of hazardous materials, bodily fluids, mold, or biohazards
Faith Janitorial Corporation reserves the right to delay, modify, refuse, or discontinue service if areas are not reasonably prepared, accessible, or safe for our personnel to perform the requested work. Additional labor charges may apply for excessive preparation, delays, waiting time, or unsafe working conditions.
9. PHOTOS, VIDEOS & DOCUMENTATION
The Customer authorizes Faith Janitorial Corporation to document work areas before, during, and after service for:
- Quality control
- Training
- Insurance documentation
- Dispute resolution
- Operational records
The Company will make reasonable efforts not to publicly disclose personally identifying information without consent.
10. BIOHAZARDS & UNSAFE CONDITIONS
Faith Janitorial Corporation does not knowingly handle hazardous materials unless specifically contracted and equipped to do so.
This includes but is not limited to:
- Human waste
- Bloodborne pathogens
- Drug paraphernalia
- Hoarding contamination
- Animal waste accumulation
- Mold remediation
- Asbestos
- Lead paint
- Chemical hazards
Discovery of hazardous conditions may require immediate suspension of work until proper remediation procedures are established.
Additional charges may apply.
11. FLOORING, SURFACES & MATERIALS DISCLAIMER
Certain surfaces and finishes may react unpredictably to cleaning processes due to age, manufacturer defects, prior maintenance methods, or improper sealing.
The Customer understands and accepts that:
- Carpet spotting may wick back
- Tile and grout discoloration may remain permanent
- Natural stone may contain hidden weaknesses
- Hardwood finishes may already be compromised
- Improperly sealed surfaces may absorb moisture or chemicals
- Window scratches may become more visible after cleaning
- Oxidized surfaces may permanently discolor
Faith Janitorial Corporation does not guarantee complete restoration of heavily neglected or permanently damaged materials.
PETS, HEALTH CONDITIONS & ALLERGIES
Customers must secure pets during services and disclose any allergies, respiratory conditions, or sensitivities before service begins.
PRESSURE WASHING & EXTERIOR CLEANING WAIVER
Pressure washing and exterior cleaning may reveal hidden defects, oxidation, or pre- existing property damage. The Company is not responsible for damages related to defective construction, poor maintenance, or improper sealing.
STAIN REMOVAL DISCLAIMER
We do not guarantee complete removal of rust, mold staining, mildew, smoke residue, odors, hard water scale, paint, or permanent discoloration.
CARPET & WINDOW CLEANING DISCLAIMER
The Company is not responsible for wick-back staining, pre-existing carpet damage, scratches, seal failures, or imperfections revealed during cleaning.
EQUIPMENT & SUPPLIES
All equipment, chemicals, and supplies remain the property of Faith Janitorial Corporation and may only be used by authorized personnel.
12. COMMERCIAL & JANITORIAL SERVICES
For recurring janitorial agreements:
- Service frequencies are based on agreed schedules
- Scope changes may require revised pricing
- Emergency requests may incur additional fees
- Staffing availability may occasionally require schedule adjustments
The Customer agrees to provide a safe workplace environment compliant with applicable laws and regulations.
13. CUSTOMER COMPLIANCE & REGULATORY REQUIREMENTS
The Customer is responsible for informing Faith Janitorial Corporation in writing, prior to the start of service, of any required certifications, compliance standards, safety protocols, training requirements, documentation procedures, recordkeeping obligations, site restrictions, inspection requirements, or regulatory standards applicable to the service location or industry.
This includes, but is not limited to:
- OSHA requirements or site-specific safety programs
- Healthcare, medical, or sanitation compliance standards
- FDA, USDA, GMP, ISO, EPA, or other regulatory requirements
- Union site rules or contractor onboarding requirements
- Facility-specific training or certifications
- Background checks or identification requirements
- Safety meetings, PPE requirements, or access procedures
- Inspection logs, SDS documentation, or cleaning verification records
- Government, municipal, state, or federal compliance obligations
- Insurance certificate requirements or additional insured requests
Faith Janitorial Corporation shall not be held responsible for non-compliance with any undisclosed customer-specific, industry-specific, governmental, regulatory, inspectional, or site-required procedures, certifications, documentation, or recordkeeping obligations that were not communicated to the Company in writing prior to the start of services.
Any additional administrative work, certifications, onboarding procedures, compliance tracking, inspection participation, reporting, or specialized documentation requested after service commencement may result in additional charges.
14. FORCE MAJEURE
Faith Janitorial Corporation shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to:
- Severe weather
- Natural disasters
- Supply shortages
- Labor shortages
- Utility interruptions
- Government actions
- Pandemics
- Transportation failures
- Acts of God
15. WEBSITE USE
By using our websites:
- Faith Janitorial Corporation
- DeepCleaners of America
you agree not to:
- Misuse forms or booking systems
- Submit false information
- Attempt unauthorized access
- Copy or reproduce Company content without permission
- Use the websites for unlawful purposes
All website content, branding, text, graphics, proposals, and media remain property of Faith Janitorial Corporation.
